One Key update: outstanding claims resolved
Over the next few weeks, a large number of members of the CFMEU engaged by One Key will have their outstanding claims resolved.
The resolution is part of a comprehensive settlement reached with One Key arising from Federal Court proceedings initiated by the CFMEU.
The terms of the settlement are subject to a confidentiality clause and cannot be disclosed.
The CFMEU has also negotiated a new enterprise agreement to apply to all One Key operations in the coal mining industry. The new agreement has superior terms and conditions of employment, including mandatory conversion to permanent employment at the request of the employee.
The CFMEU has also assisted almost 100 former employees of One Key Workforce Pty Ltd to make Fair Entitlement Guarantee claims after that company went into liquidation in September 2018.
National Legal Director Alex Bukarica said the One Key matter had faced frustrating hurdles and delays but was an important win for labour hire employees.
“We appreciate members’ patience as we have worked through some very complex legal issues.
“Nevertheless, this has been an important win. Members should be proud of funding this legal action that has had a real impact on raising standards for labour hire mineworkers.”
